1.Definition :

The Sale of Goods Act, which exists in several nations including India, the United Kingdom, Australia, and others, defines an unpaid seller. An unpaid seller, according to the Sale of products Act, is someone who has not received full payment for the products they have sold or agreed to sell.

2.Unpaid Seller's Rights:

The Sale of Goods Act gives the unpaid seller several rights to reclaim the money and seek compensation for their losses. Among these are the following:

a. Lien: Until complete payment is received, the unpaid seller has the right to retain ownership of the items. This power allows the seller to keep the items and prevent the buyer from taking possession until the seller receives payment.

b. Goods in Transit Stoppage: If the buyer becomes insolvent or unable to pay, the unpaid seller has the right to halt the delivery of goods in transit and reclaim custody of the commodities.

c. Resale: If the customer fails to pay, the unpaid seller may be able to resell the items and seek damages from the original buyer for any losses incurred.

d. Sue for Price: Even if property in the products has not passed to the buyer, the unpaid seller can sue the buyer for the price of the items.

3.Conditions for Exercising Rights:

In order to exercise the aforementioned rights, the unpaid seller must meet certain requirements, such as:

a. The vendor must be unpaid or have not received payment in full for the goods.

b. The seller must have the legal authority to sell the items. They should, for example, be the owner or have the authority to sell on their behalf.
