No Objection Certificate (NOC) in UAE: Everything you need to know

NO OBJECTION CERTIFICATE (NOC) IN UAE: EVERYTHING YOU NEED TO KNOW

A No Objection Certificate (NOC) is a crucial document in the UAE that authorizes an individual to:

  • Depart from the nation.
  • Transfer their sponsorship to a different employer.
  • Transition their work position within the same organization.
  • Apply for a fresh visa.

Who requires a NOC?

  • Employees:
Those employed in the UAE by a firm or individual sponsor must obtain an NOC from their present sponsor before leaving the country, changing jobs, or applying for new visas.
  • Dependents:
Spouses and children under the age of 18 may also require an NOC from their sponsor to travel independently or apply for a new visa.

How to obtain a NOC

  • Request a NOC:
Speak with your company or sponsor to formally request the NOC. Clearly state why you need it.
  • Submit all essential documents:
Your sponsor may request certain documentation, which can include
    • Employment Contract:
Your employment contract, either the original or a replica.
    • Passport:
A valid passport with at least 6 months of validity.
    • Visa:
A photocopy of your current UAE visa.
    • Salary Certificate:
A document that confirms your income and term of service.
    • Other documentation:
Your sponsor may seek extra documentation based on your circumstances.
  • Wait for approval:
The processing time for a NOC varies depending on the sponsor and the purpose for requesting it.
  • Receive the NOC:
When authorized, your sponsor will issue the NOC. Make sure to carefully verify the facts and ensure that all information is correct.
  • NOC for Travel:
If you require the NOC for travel, you must submit it to the General Directorate of Residency and Foreigners Affairs (GDRFA) for permission before leaving the country.

Important Considerations

  • Fees:
There may be a charge for acquiring a NOC.
  • Process time:
The processing time varies based on the company or sponsor.
  • Validity:
The NOC's validity is determined by the reason it was obtained.
  • Refusal:
Your employer or sponsor may refuse to provide a NOC. In this scenario, you should contact the Ministry of Labour for assistance.

What happens if you leave the UAE without a NOC?

Leaving the UAE without a NOC has major repercussions, including:

  • Refrain from reentering the UAE.
  • Violations of visa requirements might result in legal fines.
  • Loss of your current visa.
  • Future visa applications may be more difficult.

Tips for getting a NOC

  • When obtaining a NOC, be polite and considerate.
  • Provide all required documentation promptly.
  • Follow up with your sponsor regularly.
  • If you run into any complications, seek legal help.

Remember, obtaining an NOC is an important step in your journey in the UAE. You must have all the necessary papers and understand the process properly.
